DMCA & intellectual property policy

unOpen.AI respects the intellectual property rights of others and expects its users to do the same. This policy outlines our procedure for addressing notices of alleged copyright infringement in accordance with the Digital Millennium Copyright Act ("DMCA").

1. The "Mere Conduit" Status

unOpen.AI provides automated, private VPS hosting services. Because we employ Zero-Knowledge Encryption, we do not monitor, review, or have access to the content generated or stored by AI agents within their sandboxes. However, we will respond to valid notices of alleged infringement that comply with the requirements set forth below.

2. Reporting Infringement (Takedown Notices)

If you believe that any content hosted via an unOpen.AI instance infringes upon your copyright, please submit a written notification to our Designated Copyright Agent at legal@unopen.ai. Your notice must include:

  • Identification of the copyrighted work claimed to have been infringed.
  • Identification of the infringing material, including the specific IP address or URL associated with the unOpen.AI instance.
  • Your contact information, including address, telephone number, and email.
  • A statement of good faith that the use of the material is not authorized by the copyright owner.
  • A statement of accuracy, under penalty of perjury, that you are authorized to act on behalf of the owner.
  • A physical or electronic signature of the copyright owner or authorized representative.

3. Our Response Procedure

Upon receipt of a valid DMCA notice, unOpen.AI will:

  1. Notify the User: Forward the notice to the user associated with the instance in question.
  2. Access Restrictions: Since we cannot delete specific files within an encrypted sandbox, we may be required to suspend access to the entire instance if the user does not voluntarily remove the infringing content.
  3. Counter-Notification: Provide the user with the opportunity to submit a "Counter-Notice" if they believe the material was removed or disabled as a result of mistake or misidentification.

4. Repeat Infringer Policy

In accordance with the DMCA and other applicable laws, unOpen.AI maintains a policy of terminating, in appropriate circumstances, users who are deemed to be repeat infringers. We reserve the right to define the criteria for "repeat infringement" at our sole discretion.

5. Trademark and Other IP

This policy also applies to the unauthorized use of trademarks or other intellectual property. If you believe a hosted AI is infringing on your trademark (e.g., by impersonating a brand), please follow the reporting procedure outlined in Section 2.
